Minutes of Planning Board Public Meeting

June 25, 2005

Frye Island Community Center



The meeting was called to order by Chairman Marge Hommel at 8:05 a.m.


Members Present:  Marge Hommel, Don Nolen, Kathy Potts (secretary pro-tem)


1)               Public Hearing for Proposed Mooring Registration Ordinance

Comments and questions regarding the proposed ordinance were received from those in attendance, with Board members responding with answers and clarification.


The owner of Lot 1667 requested clarification as to whether registrations would be done on a one-time or on an annual basis.  Chairman Hommel responded that this ordinance would serve for one year in order to obtain an accurate count of all moorings currently located off Frye Island.  It was also stated that this proposed ordinance would not serve to regulate how many moorings a property owner could place outside a waterfront cottage.


Questions from owners of Lots 3037 and 247 were asked regarding the current right to place a mooring in front of private property, as well as within swimming areas of Frye Island beaches.   Attendees were reminded that without a Town of Frye Island mooring ordinance, anyone may drop a mooring at any location. 


Comments and complaints were received regarding moorings being placed off private property and near swimming areas without permission.


Concerns were voiced regarding fee structures for the proposed Mooring Registration as well as future mooring ordinances.  Attendees were reminded that no registration fee is mentioned in the proposed Mooring Registration ordinance, and any future mooring ordinance and concurrent fees were not part of the discussion.


Two people (Brian Nisula Lot 3037 and Patricia Leonard Lot 247) volunteered to serve on a committee to write a mooring ordinance;  Marge Hommel will contact Tim McCarthy, Chair of the Marina Committee, with their names.


Marge Hommel moved that the Public Hearing be closed; Don Nolen seconded the motion.  The hearing was closed at 8:35 a.m.


2)         Board Decision

After discussion, Marge Hommel moved that the topic of a Town Mooring Ordinance be referred back to the Board of Island Trustees Executive Committee for its consideration and decision.  Don Nolen seconded the motion; the motion carried unanimously.


The meeting was adjourned at 8:50 a.m. by unanimous vote.
