Planning Board Public Hearing

September 15, 2001

 

 

Location:              Community Center

Present:                Bob Hannah, Marge Hommel, Ed Charrette, Tom Burgess

      Jeanne Sullivan Toomey, Ed Johnson, and Dave Treacy

 

This Public Hearing was regarding the proposed changes to Town Ordinances, to be voted on at the October 6, 2001 Town Meeting.  Numbers 1 – 8 are in the Land Use Ordinances.  Number 9 is a new Ordinance.  Number 10 modifies Chapter 106.  Numbers 11 and 12 are rezoning.

 

Chairperson Bob Hannah gave an introductory presentation explaining that a reorganizing and editing of the Land Use Ordinances was performed by Dick Norris.

 

A general discussion followed the above.  The following motions to present articles at Town Meeting were made.

 

1.      Replace Chapter 101 – Land Use with a reorganized and edited version

2.      Change definition of Adult Day Care

3.      Clarify when a Use Variance is permitted

There was a motion to replace the word “lot” in the first line with “911 Designation”.

There was a long discussion regarding the wording of this article but only one change was made.

                              A motion was made to omit the word “original” between “mean” and “grade”.

11.       Rezone lot 501 from Water Oriented Commercial to Residential

There was a very long discussion covering numerous aspects of this issue.  It was stated that there was a lease arrangement between Mr. Treacy and the operators of the store for land between the store and the water.

 

The town of Standish had changed the zoning of 501 from residential to Water Oriented Commercial in November 1997, unbeknownst to FII.  Mr. Treacy purchased the lot in spring of 1999.  Outside legal opinions are necessary to clarify several issues.

 

Motion to table until the first meeting of the Planning Board in the spring.
