§119-1 Title:
This Ordinance shall be known as the “Ordinance for the Restriction of Fireworks use.
§119-2 Purpose:
The purpose of this Ordinance is to protect the citizens of Frye Island and their guests from personal injury, and annoyance as well as protecting the community of Frye Island from excessive fire danger.
§119-3 Definition:
“Fireworks" means any combustible or explosive composition or substance; any combination of such compositions or substances; or any other article which was prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration or detonation, including blank cartridges or toy cannons in which explosives are used, they type of balloon which requires fire underneath to propel it, firecrackers, torpedoes, skyrockets, roman candles, bombs, rockets, wheels, colored fires, fountains, mines, serpents, or other fireworks of like construction; any fireworks containing any explosive substance or flammable compound; or any other device containing any explosive substance or flammable compound.
§119-4 Requirements:
No person shall explode any type of Fireworks on Frye Island unless it is sanctioned by the Town of Frye Island Board of Selectman.
§119-5 Violations and Penalties:
Any person who explodes any type of fireworks within the Town of Frye Island in violation of the ordinance shall be guilty of a civil violation and, upon conviction, shall be fined Fifty dollars ($50.00) and not more than Five hundred dollars ($500.00) with each incident being considered a separate violation: all fines accrue to the Town.
§119-6 Enforcement:
This Ordinance shall be enforced by the Town of Frye Island Police Department, or their designees.
