Chapter 116 -- PARKING ORDINANCE

Ordinance to Regulate Parking of Motorized Vehicles and Trailers on Town Roads

ARTICLE I

Ordinance to regulate the parking of motorized vehicles and trailers on Town of Frye Island roads.

Title

This ordinance shall be known as and may be sited as “ Ordinance for Safe Parking of Motorized Vehicles, Trailers and apparatus on Town Roads in the Town of Frye Island, Maine, providing penalties for Violation Thereof,” and shall be referred to herein as “this chapter”.

Purpose

The purpose of this Ordinance is to protect the health, safety and well-being of the citizens of Frye Island by regulating the parking of motorized vehicles, trailers or apparatuses on the public roads.

Definition;

Vehicle;

For the purpose of the ordinance the term vehicle shall mean any motorized, battery powered vehicle, trailer or piece of apparatus or any trailer or piece of apparatuses that can be towed, hauled or pushed by said described vehicle.

Road;

The area of a Town Road is defined by the property line pins for the lots adjacent to the Town Roads. It is this definition of Town Road used in this ordinance.

Regulation and Prohibition of Parking

A-No Parking Street Cleaning/Construction/Event                        $20.00

A vehicle, trailer or apparatus must not park on a road within a posted construction zone.

B-No Parking Tow-Away                                                                $20.00

No motorized vehicle, trailer or apparatus shall be parked where there is an authorized Town of Frye Island no parking sign.

C-For Sale or Repair                                                                       $20.00

A vehicle, trailer or apparatus must not be parked on a road for the purpose of displaying it for sale. A vehicle, trailer or apparatus must not be repaired on Town roads except in an emergency.

D-Use of Streets for Storage                                                             $20.00

A vehicle, trailer or apparatus must not be parked on the road for more than 48 hours without movement unless parked in a legal manner as defined by this ordinance.

E-Parked on or Blocking Driveway                                                            $20.00

A vehicle, trailer or apparatus must not block, park on or across a driveway.

F-Wrong Way                                                                                $20.00

A vehicle, trailer or apparatus must not park facing the wrong direction or against the flow of traffic.

G- Parking within 50’ of Intersection.                                          $20.00

A vehicle, trailer or apparatus must not park within 50’ of an intersection.              

H-Parking at Angle                                                                       $20.00

Vehicles, trailers or apparatus must park parallel to roadside.                                               

I-Fire Hydrant                                                                                $50.00

A vehicle, trailer or apparatus must not park within 15 feet of a fire hydrant.

J-Emergency designated parking area                                          $50.00

A vehicle, trailer or apparatus must not park in a spot, or block access, designated for emergency vehicle parking or an area designated for emergency vehicle turn around.

K-Creating narrow vehicular traffic flow                                     $20.00

Motorized vehicles, trailers and apparatus may be parked on Town Roads as long as a minimum path of 12 feet in width is maintained to permit safe and expedient passage of fire trucks, EMS vehicles and other large vehicles permitted on Town Roads.

L- Handicapped parking zone.                                                      $250.00

No vehicle, trailer or apparatus shall park or block access to a designated handicapped parking spot without proper handicapped registration plate or handicap placard.

The above paragraphs “A” through “L” shall be enforced unless otherwise posted.

Violations and Penalties

Any person who violates any of the provisions of this ordinance shall be guilty of a civil violation and, upon conviction, shall be fined not less than twenty dollars ($20.00) and not more than two hundred and fifty hundred dollars ($250.00) with each incident being considered a separate violation.  A warning may be issued for a first offense.  All fines accrue to the Town of Frye Island.

Enforcement

This ordinance shall be enforced by the Town of Frye Island Police Department, the Cumberland County Sheriff’s Department, or others that may be designated by the Town.
