BOARD OF APPEALS

MINUTES OF MEETING OF AUGUST 19, 2005

 

Meeting Called to order at 7:00 p.m.

 

Present were E. Wrzesinsky, B. Aranyi, J. Gardner, T. McCarthy and CEO P. White.

 

Unable to attend was R. Kaplan..

 

1.  B. Aranyi moved the minutes of the July 22, 2005 meeting.  Seconded by T. McCarthy and unanimously approved .

 

2.  On motion by J. Gardner and 2nd by B. Aranyi the board voted 4 to 0 to table the Toomey

appeal to the September 23, 2005 meeting.  This was requested by Mr. Toomey’s attorney.

 

3.  The Rivard, Lot 1104, Hardship Variance appeal was heard:

Mr. Rivard advised that no mortgage financing was available because of no clear title.  Therefore it would have no resale value.  Norway Savings Bank had turned him down because the house was nine (9) inches too close to the front property line.

 

A. Rogers, the contractor,  placed the house too close to the front property line when they did the excavating, this having nothing to do with the neighborhood.

 

Houses and building along side his are closer to the road, so this will not alter the neighborhood.

 

The original setback was set by measuring from a string between the front pins and was 50 feet.  Large rocks may have caused the contractor to move the building. 

 

E. Wrzesinsky asked the applicant which buildings were closer to the road?  Applicant advised that the house on the left and the garage on the right.

 

J. Gardner asked the applicant if he had talked to a surveyor?  Applicant asked surveyor to come back because he measured 50' 3" but he would not.

 

Jim O’Connor, owner of  Lot 1103, addressed the board and asked that the variance be approved because he lives next door and the house is further back from the road than his garage.

 

The Board voted, by separate votes, of 4 to 0 to accept the Findings of Fact, the Conclusions and to grant the Hardship Variance of 49' for the front setback.

 

4.  The Tedford, Lot 208, Hardship Variance appeal was heard:

Chairman Wrzesinsky advised the board that the Tedford appeal was not submitted in the 30 day time period after notice of violation as required by Chapter 101D, III D 16, I 3 i of the Shoreland Zoning Ordinance of the Town of Frye Island.  Upon a motion by T. McCarthy and a 2nd by B. Aranyi the board voted 4 to 0 to hear the appeal.

 

Chairman Wrzesinsky ask the applicant to clarify his application as the violation notion was for multiple violations but his application only address one.  Mr Tedford requested that his application be amended to cover the following Variance needs:

1.  Sideline variance for garage from 15' to 11' 2".

 

2.  Sideline variance for deck from 15' to 11' 2".

Upon motion by T. McCarthy and a 2nd by J. Gardner the board voted 4 to 0 to amend the Tedford application.

 

Mr. Tedford requested the application be tabled to the September 23, 2005 meeting.  Upon a motion by B. Aranyi and 2nd by J. Gardner the board voted 4 to 0 table the application.
